Engrossed House Bill 1595 took effect July 23, 2017 and enacted new requirements for charging for records under the Public Disclosure Act.  The bill provides charging options, including other amendments to the Act.  DEL is updating chapter 170-01 WAC to implement EHB 1595, including clarifying charging information, explaining when fee waivers may be allowed, and better explaining payment requirements.

DEL initiated this rule making on July 21, 2017 by filing the preposal statement of inquiry (CR-101).  Because there was insufficient time between the passage of EHB 1595 and its effective date to complete the permanent rule making process, DEL adopted emergency rules to clarify that it will not charge fees for producing public records that exceed the schedule found in RCW 42.56.120(2), explaining when fee waivers may be allowed, and better explaining payment requirements.

Final rules were adopted October 27 and will take effect November 27, 2017.
